Terms of Service
These Terms govern the use of Hostingcone websites, hosting-related products, website services, and associated customer services.
1. Acceptance of Terms
By ordering, accessing, or using Hostingcone services, you agree to the applicable terms of your order, these Terms, and any product-specific conditions made available to you. If you act for a business or other organisation, you must have authority to accept those terms on its behalf.
Read these Terms before purchasing or using a service. If you do not agree, do not order or use that service. Mandatory rights under applicable law are not excluded by these Terms.
2. Services Covered
These Terms cover Hostingcone websites, hosting-related products, website services, domains, and associated customer services. The services available to you are those identified in your order or service agreement; descriptions on the website do not mean every feature is included in every purchase.
A product-specific agreement, plan description, or agreed scope may set additional conditions for that service. Any differences between these documents should be clarified before work or service activation.
3. Account Registration and Customer Responsibilities
Provide accurate account, contact, and billing information, and keep it current. You are responsible for authorised activity on your account and for protecting credentials, managing user permissions, and notifying Hostingcone of suspected unauthorised access.
You must hold the necessary permissions, licences, and content rights for your website, software, domains, and data. Supply accurate instructions and cooperate with reasonable service requirements. Review the separate Privacy Policy for information about personal-data handling.
4. Acceptable Use
Use the services lawfully and in accordance with applicable product conditions and the separate Acceptable Use Policy. Do not use them for fraud, unlawful spam, malware distribution, unauthorised access, infringement, or activity that unreasonably disrupts systems or other customers.
Customers are responsible for the material they upload or make available and for the conduct of users they authorise. Resource limits and technical restrictions depend on the purchased service.
5. Hosting and Website Services
Hosting provides the environment in which eligible website files, applications, and related services operate. You remain responsible for your content, application configuration, software licences, and website administration unless specific responsibilities are expressly included in an agreed service.
Compatibility and performance depend on the application, configuration, resource use, and other technical factors. A hosting purchase does not itself include website development, repairs, maintenance, security work, or migration unless these are identified in the purchased service or agreed scope.
6. Domain Registration and Transfers
Domain registrations, renewals, and transfers are subject to availability, eligibility requirements, and applicable registrar and registry rules. A requested domain or transfer is not confirmed merely because an order has been submitted. Transfer approvals, locks, verification, and processing requirements may be controlled by third parties.
Keep registrant information accurate and review the applicable renewal and transfer conditions. Domain registration does not establish ownership of a trademark or confer other legal rights in a name. You are responsible for checking that your registration and use do not infringe another party’s rights.
7. Third-Party Products and Services
Some products or service components may be supplied through third-party vendors or platforms. Their terms, licences, privacy practices, usage conditions, and technical limitations may also apply. Review those conditions before using the relevant product.
Third-party availability, pricing, capabilities, policies, and support arrangements may change independently of Hostingcone. Hostingcone’s responsibilities for a particular third-party product depend on the relevant order or agreement; purchasing through Hostingcone does not guarantee the vendor’s continued service or any particular result.
8. Website Care, Maintenance, and Technical Support
The scope of Website Care, maintenance, troubleshooting, repair, migration, optimisation, or technical support depends on the service or plan purchased and any agreed work description. Tasks outside that scope may require a separate agreement before work begins.
Troubleshooting and repair outcomes are not guaranteed. Third-party software, themes, plugins, APIs, hosting environments, and vendors may affect compatibility, access, timing, and results. Customer cooperation, appropriate access, accurate information, and permission to make agreed changes may be required. Provide credentials only through an agreed secure method.
9. Payments, Billing, Renewals, and Taxes
Charges, billing cycles, renewal arrangements, and applicable taxes are governed by your order, invoice, and relevant product-specific terms. Review recurring charges and renewal conditions before purchasing and keep your billing information and payment arrangements current.
You are responsible for amounts properly due for the services you order. Payment problems may affect service availability, subject to applicable law and the relevant service conditions. Contact Hostingcone through its existing customer channels if you believe an invoice or charge is incorrect.
10. Cancellations
Request cancellation through the available Hostingcone customer-service or account channels. The process and effective date depend on the relevant service and its product-specific terms; this draft does not set a universal cancellation deadline.
Before cancelling, arrange any required transfer or export of your website, domains, email, and other data. Cancellation does not itself guarantee a refund or continued access to data. Refund questions are addressed by the separate Refund Policy and applicable product terms.
11. Refunds
Refunds are governed by the separate Hostingcone Refund Policy and by any product-specific terms, subject to applicable law. This draft does not establish a refund period, eligibility rule, or universal money-back guarantee.
Contact Hostingcone with the relevant order or invoice details to discuss a refund request. Review the applicable conditions for third-party products and domain services as well as any mandatory rights that cannot legally be excluded.
12. Service Availability and Maintenance
Services may be affected by planned maintenance, updates, faults, network conditions, third-party systems, or other interruptions. Hostingcone does not promise 100% uptime or uninterrupted or error-free service through these Terms.
Any service-level commitment applies only where expressly included in the agreement for the relevant service. These Terms do not create an SLA, a guaranteed response time, or automatic service credits. Maintenance and incident handling depend on the service and applicable arrangements.
13. Backups and Customer Data
You remain responsible for maintaining appropriate independent backups of important content and data, and for checking that your recovery arrangements meet your needs. If a purchased service includes backups, its scope, retention, and other conditions depend on that service’s terms.
Backups are a recovery aid and are not a guarantee against data loss. Successful restoration, completeness, availability, and recovery time cannot be guaranteed. Loss, corruption, technical restrictions, or third-party conditions may affect recovery. Export needed data before cancelling or changing a service.
14. Security Responsibilities
No security measure can eliminate all risks. Security products and agreed security work do not guarantee malware prevention, protection from every attack, or successful remediation or recovery.
Customers remain responsible for appropriate credentials, access controls, licensed software, application updates, and the security of systems they control, except for tasks expressly assigned under a purchased service. Use suitable authentication safeguards where available and report suspected compromise through Hostingcone’s existing support channels.
15. Intellectual Property
You retain any rights you already hold in your content. You must have the rights and permissions needed for Hostingcone and relevant providers to host, process, or work with that content to deliver the agreed services.
Hostingcone and third-party providers retain their respective rights in their software, branding, documentation, and other materials. A service purchase does not transfer those rights or override applicable licences. Do not submit or use material that infringes another party’s intellectual property or other legal rights.
16. Suspension and Termination
Services may be restricted, suspended, or terminated where permitted by applicable law and service terms, including for non-payment, unlawful use, material breach, security risks, or binding legal requirements. The appropriate action depends on the circumstances and applicable agreement.
Notice and opportunities to resolve a problem will depend on legal requirements, the service terms, and whether urgent protective action is necessary. Suspension or termination may limit access to your services and data. Maintain independent copies and arrange transfers or exports where possible.
17. Disclaimers
To the extent permitted by applicable law, services are supplied on an “as available” basis and without promises of results beyond those expressly included in the relevant agreement. Website performance, search rankings, security, backup recovery, and troubleshooting outcomes are not guaranteed by these Terms.
Nothing here excludes statutory rights or warranties that cannot lawfully be excluded. Any additional express commitment must be assessed against the agreement for the specific service.
18. Limitation of Liability
To the extent permitted by applicable law, Hostingcone seeks to exclude liability for indirect or consequential losses, including lost profits, business interruption, or lost opportunities arising from use of the services. Any exclusion remains subject to rights and liabilities that cannot lawfully be excluded or limited.
Business/legal review item: confirm appropriate liability limitations, exceptions, and any monetary cap before publication. This draft does not set a specific financial cap and does not limit liability where doing so would be unlawful.
19. Indemnification
To the extent permitted by applicable law, you agree to reimburse reasonable losses and costs arising from third-party claims caused by your unlawful use of the services, infringing customer content, or material breach of the applicable terms. This obligation does not extend to claims caused by Hostingcone’s own breach or conduct for which it remains legally responsible.
Business/legal review item: confirm the scope of this clause, claim-handling procedures, and applicable limitations before publication.
20. Changes to Services or Terms
Services and these Terms may need to change to reflect technical, operational, vendor, or legal developments. Changes must be handled in accordance with applicable law and any existing service agreement, including any required notice or customer rights.
Review the terms made available for a new order or renewal. This draft does not authorise retrospective changes that override mandatory rights or an existing contractual commitment.
21. Governing Law
Business/legal review item: Hostingcone and qualified legal counsel must confirm the governing jurisdiction and any lawful dispute-resolution arrangements before publication. This draft does not designate a country, state, court, or arbitration procedure.
Any governing-law clause must preserve applicable mandatory consumer protections and other rights that cannot legally be excluded.
22. Contact Information
For questions about these Terms, accounts, billing, or services, use the Hostingcone Contact page or the existing customer contact form. For account-specific or technical requests, the existing Contact page recommends using your client area or submitting a support ticket from it.
Include a relevant service or invoice reference and a clear description of your question. Do not send passwords, full payment-card details, or other sensitive credentials through the contact form.
This document should be reviewed by qualified legal counsel before final publication.
